A document obtained exclusively by NeoFeed , and signed by the Federal Police, officially shows how the corporation opposes the anti-mafia project - the document was sent to the Public Security Secretariat.
This is yet another chapter in the controversial creation of ANEOC, an idea championed by aides to Minister Ricardo Lewandowski to distribute the power of the Federal Police in investigations against organized crime. Among its proponents are members of the Public Prosecutor's Office.
The study by the Federal Police, conducted by the Drug Enforcement Division, indicates that the initial project creates overlapping functions between public agencies and even criticizes the very format in which the proposal was created, via decree.
The Ministry of Justice's intention is that the agency would have the function of coordinating actions by corporations against groups with mafia-like characteristics, including money laundering, territorial control, and even infiltration into security forces.
The new body would, as the project foresees, be linked to the Ministry of Justice, but would have autonomy in its coordination, with fixed terms for its members, as is the case in other regulatory agencies and also in the Central Bank. The government's proposal includes the infiltration of agents into these organizations.
Federal Police delegates oppose the text because they believe the proposal weakens the corporation's command. The Federal Police document attempts to demonstrate the project's unfeasibility. "In this sense, the creation of a National Agency for Combating Criminal Organizations (ANEOC) could lead to interpretations of overlapping or duplication of responsibilities," says the text obtained by NeoFeed .
According to the text, it would be “important for the project to clarify what the responsibilities of ANEOC would be. This is a new structure linked to the Ministry of Justice and, in our opinion, it should expressly state that ANEOC will have a strategic and advisory role, being responsible for formulating national guidelines and integrating policies to combat criminal organizations, so that there is no overlap.”
The delegates also criticize the creation of the agency by decree. "Despite the provision in the Bill (article 23-A) that the regulation of ANEOC would be carried out via decree, we believe it is more appropriate, from the point of view of legal certainty, that the nature of this future agency be written in the text of the Bill," says the Federal Police document.
The strategy is for the text to be discussed by Congress, increasing the chances of it being blocked. "Relevant issues arise from the legal nature of this new agency and need to be analyzed in depth, otherwise the main objective of the Bill—a tougher stance against organized crime—will be jeopardized."
